No, in short a will is part of your estate plan. An estate plan is more comprehensive and includes all of your assets (everything from large investment accounts and real estate to your instagram account and library card). The Will only covers probate assets, which are assets in your name only at death. For example, if you have a co-owner, beneficiary, or a trust owning an asset, those will pass automatically, and the Will will not apply.

There are lots of reasons it’s better to avoid going through the courts. First, the courts are extremely slow as they’re generally understaffed and still backed up from COVID. Second, you’ll need an attorney to file complex and time-consuming paperwork if you go through the courts. The attorney’s fees to do this cost more than getting your estate plan done in advance. Third, everyone is named in the Will and an heir at law must be given notice of someone passing. So if you disinherit someone, they will still get notice that they’re being disinherited. And lastly, anything filed at the court is public record.

Our 5-step process is super streamlined. So as long as you fill out your questionnaires and get us your information in a timely manner, we can typically have your finalized estate plan within three to four weeks.

How long does this process typically take?

Unfortunately yes, these documents require two witnesses plus a notary. However, we’ve developed a really organized process that allows you to stay in your car and sign all of your documents within 15 minutes.
